General Terms and Conditions (GTC)

for AW recruiting

1. Scope of Application
These General Terms and Conditions apply to all services provided by AW-Recruiting, Margaretenweg 7 86842 Türkheim. By using our services, the customer accepts these terms and conditions.

2. Conclusion of contract
The contract is concluded when the customer accepts an offer from AW-Recruiting. Acceptance can be made in writing, by telephone or by e-mail.

3. Services
AW-Recruiting offers services in the field of personnel placement and recruiting. The exact services are specified in the respective contract with the customers and companies.

4. Remuneration
The remuneration for the services of AW-Recruiting is specified in the contract. All prices are exclusive of VAT.

5. Obligations of the customer
The Client undertakes to truthfully provide AW-Recruiting with all necessary information necessary for the provision of the Services. The Client shall ensure that all necessary legal and regulatory requirements are complied with when hiring the Candidate.

6. Liability
AW-Recruiting is only liable for damages caused by intentional or grossly negligent conduct. Liability for indirect or consequential damage is excluded. AW-Recruiting does not assume any liability for the accuracy and completeness of the information provided by the candidates. The Client undertakes to carry out its own verification of qualifications and references before hiring a Candidate.

7. Data protection
AW-Recruiting undertakes to comply with the data protection regulations and to treat the customer's personal data confidentially. You can find out more about our privacy policy on our website:

9. Candidate profiles and data protection
AW-Recruiting provides the client with candidate profiles that contain personal data of the applicants. The Client undertakes to use this data exclusively in the context of recruitment and in accordance with the applicable data protection regulations (in particular GDPR).

10. Terms of payment
Payments are to be made in accordance with the conditions set out in the contract. If payment is not made within the agreed payment period, AW-Recruiting is entitled to charge interest on arrears or a reminder fee.

11. Agency Fee and Refund
In the event that the identified candidate is hired, AW-Recruiting will charge a placement fee specified in the contract.

If a candidate leaves the company within the guarantee period agreed in the contract, which corresponds to the statutory probationary period (max. 6 months), a pro-rata refund of 25% of the agreed net amount will be made. (However, this only applies to a direct placement with the candidate's employer). In the case of a placement with another recruiting or placement company, this guarantee period does not apply.

12. Termination
The termination of the contract must be made in writing by both parties. By signing the purchase contract, the customer undertakes to pay 100% of the costs incurred (e.g. flight costs, applications, etc.) in the event of termination by the customer. If no costs have yet been incurred, there are no costs for the customer.

13. Confidentiality
Both parties undertake to treat all confidential information exchanged in the course of the cooperation as strictly confidential and not to disclose it to third parties.

14. Final Provisions
Changes and additions to these GTC must be made in writing. If any provision of these GTC is invalid, the validity of the remaining provisions shall remain unaffected.

The law under the committee of private international law applies. The place of jurisdiction for all disputes arising from this contract shall be the registered office of the district of AW-Recruiting, unless otherwise agreed.

Should any provision of this contract be or become invalid, the remaining provisions shall remain unaffected. The invalid provision shall be replaced by a valid provision that comes as close as possible to the economic purpose of the invalid provision.
